1. Basis Of Contract
1.1 Ashmore Plant Hire will not be liable for any losses suffered by the customer where the Goods for hire are unavailable due to circumstances outside of the suppliers’ control.
2.1 In the event of a drop-off location being outside a 10-mile radius of the WS6 area a deposit or full payment may be required prior to the day of delivery at the discretion of the supplier.
2.2 The customer shall pay rental charges at the time and in the manner agreed between the supplier and the customer.
2.3 The customer must pay in full on or before the first day of the rental period. Possession of the machinery will not be handed over until full payment has been received.
3. Risk and Insurance
3.1 Risk of the goods will pass immediately to a customer when they leave the possession or control of the supplier.
3.2 The customer is responsible for any insurance cover during the rental period. The supplier will not be liable for any damage done by or to the machinery during the rental period.
4. Care of Goods
4.1 The customer shall:
4.1.1 Not remove any labels from and/or interfere with the machinery, the mechanics or any other parts and will take reasonable care of the goods whilst in their possession.
4.1.2 Notify the supplier immediately after any breakdown, loss or damage to the Goods.
4.1.3 Take proper measures to protect the Goods from theft, damage and any other risks.
4.1.4 Notify the supplier of any change in location of the Hire Goods during the rental period.
4.1.5 Will not continue to use the machinery if they have been damaged and must notify Ashmore Plant Hire immediately if the machine has been involved in any accident resulting in damage to the Hire Goods.
4.1.6 Where the machines require fuel, oil or electricity, the customer must ensure that the correct type and/or voltage is used.
4.1.7 Ensure that any person(s) operating the goods during the rental period are adequately trained to do so.
5. Loss Or Damage
5.1 The Hire Goods must be returned in good working condition and in a clean condition (deemed by the supplier).
5.2 If on collection the Goods are exceptionally unclean and deemed misused, this will result in an additional cleaning charge of £40.00 + VAT.
5.3 In the event of a lost key or broken beacon, a charge of £60.00 + VAT will be required to compensate for the damage/loss.
6.1 In the event of a breakdown during the rental period, the customer should contact the office within a reasonable time.
6.2 The customer will be responsible for all expenses, loss and/or damage to the machinery which has been caused due to the customers neglect and or/misuse of the Hire Goods.
7.1 In the event of cancellation, the customer must give at least 5 days’ notice prior to the agreed rental date. Failure to do so, may result in the rental period still being chargeable (at the discretion of the supplier).
7.1.1 For late bookings (i.e. bookings agreed less than 5 days in advance) the customer should notify the supplier of cancellation with at least 24 hours’ notice prior to delivery. Failure to do so, may result in the rental period still being chargeable (at the discretion of the supplier).
